PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING THE SERVICES OFFERED BY ESCRIBOLT. BY DOWNLOADING THE APPLICATION, ACCEPTING THESE TERMS, OR ACCESSING THE CLOUD SERVICES, YOU ("CUSTOMER") AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY.
1. Scope of Services & License
Escribolt provides a desktop application ("Application") and managed backend cloud services ("Services") for voice transcription, note-taking, and AI-driven workflows.
- Desktop Client License: Your right to download, compile, or modify the desktop client source code is governed by the Business Source License 1.1 (BSL 1.1) as detailed in our Open Source License Guide.
- SaaS Cloud Services: For paid Pioneer and Founder tiers, Escribolt grants you a limited, non-exclusive, non-transferable right to access our cloud relays, database sync, and high-speed AI processing during your subscription period.
2. User Responsibilities & API Credentials
If you configure the Application to run in **Bring Your Own Key (BYOK) Mode**, you are solely responsible for procuring, managing, and paying for your own API accounts with third-party providers (such as Deepgram, OpenAI, Anthropic, or Gemini). Escribolt is not liable for any costs, rate limit blocks, or security issues arising from your personal API key usage.
3. Recording Laws & Consent
Escribolt allows you to record microphone and system audio (e.g., video calls, meetings). You are solely responsible for complying with all applicable recording and wiretapping laws in your jurisdiction. You represent and warrant that you have obtained all necessary consents from participants before initiating any audio recording or transcription session.
4. AI Output Disclaimer
Due to the probabilistic nature of machine learning, AI-generated transcriptions, summaries, and chat responses ("Outputs") may occasionally contain errors, misstatements, or inaccuracies (hallucinations). You acknowledge that you use all Outputs at your own risk. Before relying on any Output for business or legal decisions, you are responsible for reviewing and verifying its accuracy.
5. Fees, Subscriptions & Quotas
Pioneer and Founder plans are billed on a recurring monthly or annual basis.
- Payment: All fees are paid upfront and are non-refundable. Subscriptions renew automatically unless canceled at least 30 days prior to the renewal date.
- Usage Limits: Paid plans are governed by resource quotas (e.g., transcription hours and AI requests). Unused quotas do not roll over to the next billing period.
- Fair Use Policy: Unlimited cloud features are subject to our Fair Use Policy for human workflows. Abuse or automated scraping of the APIs will result in immediate service suspension.
6. Limitation of Liability
Escribolt is designed as a local-first application where your primary data resides in a local SQLite database on your device. Escribolt is not liable for any data loss, database corruption, or hardware crashes. You are solely responsible for maintaining regular backups of your local data.
To the maximum extent permitted by law, Escribolt's total liability under these terms shall not exceed the amount paid by you to Escribolt in the twelve (12) months preceding the incident.
